Important Decisions About Alimony

    Sometimes called spousal support or spousal maintenance, alimony is money paid by one spouse to the other after a divorce or legal separation. There is no standard formula for determining whether or how much alimony is paid, as there is for child support. Spousal support is decided on a case-by-case basis.

What Factors Into the Alimony Decision?

    The court considers a number of factors in the decision regarding alimony, including the length of marriage, the ages of the two parties, their financial need, education level, employment prospects, relative earning capacity and ability to pay.

    Spousal support may be awarded on a temporary basis while the divorce is pending. In addition, rehabilitative alimony may be awarded temporarily while the recipient looks for a job or obtains the training he or she may need to secure employment.

This is one of the most litigated areas in all of family law. There are no specific statutes or formulas to guide us — just a litany of cases handed down by the Nevada Supreme Court.
